While bankruptcy may provide a way out of your current financial situation, you need to consider and be aware that the ramifications of filing bankruptcy are going to haunt you for the next 7 to 10 years.  Many people who file bankruptcy are doing so to make things better &#x201C;now&#x201D; but they are not looking years down the road, and when they do and wish they had considered other options, it is then too late.</p>
<p>&#xD;</p>
<p>If you are on the very edge of filing bankruptcy and need a way out, there are multiple other options that may be available to you.  If you feel like you&#x2019;re hopelessly buried in debt and you have very few assets, filing for bankruptcy may not be the answer to ending your financial problems.  Though it sounds like an easy and attractive solution for one&#8217;s financial problems, bankruptcy should be the last option any individual should resort to.  </p>
<p>&#xD;</p>
<p>Throughout the process of filing for bankruptcy, it is a good idea to have a lawyer represent you through all formal bankruptcy proceedings.  Unless you yourself are very familiar with bankruptcy law, especially the variations of the law within your state, it is more than just a good idea to have a bankruptcy lawyer represent you; it is almost a necessity so that you don&#x2019;t accidentally get yourself into worse trouble than you are right now.  From start to finish, the process of filing for bankruptcy is much different than it has been in decades past, and a good  bankruptcy attorney knows those pitfalls and can navigate around them. </p>
<p>&#xD;</p>
<p>Before taking the big step and filing for bankruptcy, you will need to do some reading, especially so that you can explain to your bankruptcy attorney the reason for considering bankruptcy.  You may need to consider filing bankruptcy if your expenses are increasing because of divorce, job loss, or medical bills, while your income is decreasing because of the same reason.  There are various good reasons for filing bankruptcy, but there are also many BAD reasons for filing bankruptcy, based on the ease with which one could do that in years past, but most of those loopholes have been closed, and it is not nearly as easy today to file a non-painful bankruptcy case.  </p>
<p>&#xD;</p>
<p>If you have decided there is no alternative to filing bankruptcy, you may be asking yourself, &#8220;how do I find a good bankruptcy lawyer?  If you have exhausted all other resources and still feel bankruptcy is your only viable option you can learn more about filing bankruptcy or buy do it yourself bankruptcy forms.  If you&#x2019;re unemployed, on public assistance, have little or no money in a bank account, don&#8217;t own an automobile, or rent or live with others, filing for bankruptcy may do little to improve your financial situation.  The bankruptcy judge is going to want to see a plan of how you plan to change your current situation so that you are not back in the same position in another few years, so be sure that you discuss a financial plan with your bankruptcy lawyer.</p>

Many people, at many times, have problems paying their debts. You may find yourself in a situation where you simply can&#xE2;&#x80;&#x99;t pay all your bills. </p>
<p>&#xD;</p>
<p>This is an incredibly difficult time. You have grown up believing that honest people pay their debts. You consider yourself honest, but you can&#xE2;&#x80;&#x99;t pay your debts. Once the collection agencies get involved, things get nasty. Collection agencies try to make you feel like a bad person. It&#xE2;&#x80;&#x99;s their job to intimidate and shame you into paying the debt, no matter what. </p>
<p>&#xD;</p>
<p>Collection agencies are not in charge of deciding who is a good and bad person. You&#xE2;&#x80;&#x99;re not a bad person because someone on the other end of the phone says so. You are a good person with a debt problem. This could happen to anyone, and it does happen to a lot of people. Sometimes even huge corporations go bankrupt; it happens.</p>
<p>&#xD;</p>
<p>The focus now is on how you can get out of this situation. You may be able to get help from a credit counselor. This may be a good course for you, if you are having difficulty solving the problem on your own. </p>
<p>&#xD;</p>
<p>Before you sign up with a credit counseling firm, research the firm carefully. Some &#xE2;&#x80;&#x9C;non-profit credit counseling&#xE2;&#x80;&#x9D; organizations are not what they seem. Make sure you&#xE2;&#x80;&#x99;re working with a real credit counseling firm, and that they have a good reputation. If your creditors won&#xE2;&#x80;&#x99;t work with them, they&#xE2;&#x80;&#x99;re not going to be able to help you.</p>
<p>&#xD;</p>
<p>The most important thing is to make sure the money you send goes to your creditors, and that your creditors agree to the plan your credit counselor puts together. If your creditors don&#xE2;&#x80;&#x99;t agree, you&#xE2;&#x80;&#x99;re still on the hook.</p>
<p>&#xD;</p>
<p>You should avoid, at all costs, &#xE2;&#x80;&#x9C;credit settlement&#xE2;&#x80;&#x9D; firms. These companies collect payment from you, withhold it from your creditors, and then attempt to make a &#xE2;&#x80;&#x9C;lump sum&#xE2;&#x80;&#x9D; settlement. The problem is that during the many months you&#xE2;&#x80;&#x99;re paying them, your creditors are not getting paid, and have not signed any agreement with the credit settlement firm. So you can be sued by your creditors and have your wages garnished, while the credit settlement firm enjoys the use of your money. Very few people find these firms useful in overcoming their debt problems.</p>
<p>&#xD;</p>
<p>A credit counselor can help you reach an agreement with your creditors about paying off your debts, and can help you keep that agreement. You pay the credit counseling firm, and they pay your creditors. Your creditors will agree to work with you because they believe they&#xE2;&#x80;&#x99;ll be paid, and you have a chance to get back on your feet.</p>
<p>&#xD;</p>
<p>If you&#xE2;&#x80;&#x99;re over your head in debt and can&#xE2;&#x80;&#x99;t see any way out, consider credit counseling. Find a good, solid organization with a great reputation, and ask them if they can help you. Understand that you will be able to pay off your debts with their help, but you will have to change your spending and debting habits to avoid falling back into the same situation later. If you&#xE2;&#x80;&#x99;re prepared to do that, credit counseling can help. </p>

Congress passed the Bankruptcy Code under its Constitutional grant of the authority to establish a uniform law on the subject of bankruptcy throughout United States. States may not regulate bankruptcy though they may pass the laws that govern other aspects of the debtor-creditor relationship. </p>

<p>Bankruptcy allows a debtor, who is unable to pay his creditors to resolve his debts through the division of his assets among his creditors. Certain bankruptcy proceedings allow a debtor to stay in business and use the revenue generated to resolve his or her debts. A United States Bankruptcy court supervises bankruptcy proceedings and is where bankruptcy is litigated. Proceedings in bankruptcy courts are governed by the Bankruptcy Rules which were promulgated by the Supreme Court under the authority of Congress.</p>

<p>How Do Bankruptcy Proceedings Work? </p>
<p>&#xD;</p>
<p>Informally called &#8220;straight bankruptcy,&#8221; The most common type of bankruptcy proceedings liquidation involves the appointment of a trustee who collects the non-exempts property of the debtor, sells it and distributes the proceeds to the creditors. </p>

<p>Chapter 11 is reorganization. In this chapter the debtors are allowed to continue its operations while paying their debts. The debtor can either enter the bankruptcy proceedings or it can be initiated by the creditors. The creditors may not seek to collect their debts outside the proceedings at the most part, after the bankruptcy proceedings is filed. The latest revisions of the bankruptcy law are now in effect. Before the debtor can file a bankruptcy case, they should undergo credit counseling, budgeting and debt managements before the debt is wiped out. </p>

<p>Bankruptcy attorneys explain the applications of bankruptcy laws and its applications. If the debtors or their lawyers set off the bankruptcy it is called a voluntary bankruptcy. If the courts initiate the bankruptcy it is called an involuntary bankruptcy. A good bankruptcy attorney will take all the problems away from the bankrupt person or company and deal with every aspect of the bankruptcy. </p>

<p>6 Helpful Tips and Considerations For Finding the Best Bankruptcy Attorney </p>

<p>1. Find a bankruptcy lawyer at the circle of your acquaintances. Keep in mind that bankruptcy law is a specialty, so if your lawyer offers to handle the case as part of your usual retainer, make sure he knows his way around a bankruptcy court.</p>
